Terms of Service
The terms governing your use of SecureNet Fiber services.
Effective Date: July 1, 2025
These Terms of Service ("Terms") constitute a legally binding agreement between you ("Subscriber", "you", or "your") and WV AirNet, LLC d/b/a SecureNet ("SecureNet", "we", "us", or "our"). These Terms govern your subscription to and use of SecureNet's fiber Internet, voice, and related telecommunications services (collectively, the "Services"), as well as any equipment provided by SecureNet in connection with those Services.
By subscribing to, activating, or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, do not use our Services.
1. Eligibility and Acceptance
To subscribe to our Services, you must be at least 18 years of age and have the legal authority to enter into a binding agreement. By completing a service application, signing a service agreement, or activating Services, you confirm that you meet these requirements and accept these Terms in full.
SecureNet reserves the right to verify your identity, creditworthiness, and service address eligibility before provisioning Services. We may decline to provide Services at our sole discretion.
2. Term and Renewal
Residential Services
Residential service subscriptions are provided on a month-to-month basis unless otherwise specified in a separate written agreement. Your service will automatically continue each month until terminated by you or by SecureNet in accordance with these Terms.
Commercial Services
Commercial and business service subscriptions may be subject to a defined service term as specified in your service agreement. The length of the initial term, renewal terms, and any associated pricing commitments will be set forth in your individual service agreement. If no specific term is stated, commercial services are provided on a month-to-month basis.
3. Fees, Installation, and Payment
Installation
Standard installation of SecureNet fiber service is provided at no charge. Installation includes the placement of a fiber drop to your premises and the installation of a Network Interface Device (NID), Optical Network Terminal (ONT), and wireless router. Installation is typically completed in two visits -- an outside fiber drop placement (usually completed approximately one day before your appointment) and an inside installation appointment lasting approximately 60 to 90 minutes.
Monthly Service Fees
Your first month's service charge is due at the time of installation. Subsequent monthly charges are billed in advance and are due on the date specified on your invoice. Service fees are based on the plan you select and are subject to change with 30 days' written notice.
Late Fees
Payments not received within 30 days of the invoice date may be subject to a late fee as specified on your billing statement. SecureNet reserves the right to suspend or terminate Services for accounts with outstanding balances.
Taxes and Regulatory Fees
Your bill may include applicable federal, state, and local taxes, fees, surcharges, and regulatory assessments. These charges are determined by governmental and regulatory authorities and are subject to change.
Payment Methods
SecureNet accepts payment by check, debit card, and bank bill pay. Additional payment methods may be made available at our discretion.
4. Equipment
All equipment provided by SecureNet in connection with your Services -- including but not limited to the ONT, router, and NID -- remains the property of SecureNet at all times. You are responsible for the care and safekeeping of all SecureNet-owned equipment while it is installed at your premises.
Upon termination of your Services for any reason, you must return all SecureNet-owned equipment within 15 days. Equipment must be returned in good working condition, reasonable wear and tear excepted. Failure to return equipment within the specified timeframe may result in equipment replacement charges being applied to your account.
You may not modify, tamper with, reverse-engineer, or attempt to repair SecureNet-owned equipment. If equipment malfunctions or is damaged, contact SecureNet to arrange for repair or replacement.
5. Subscriber Obligations
As a subscriber to our Services, you agree to:
- Provide accurate and complete information when applying for and maintaining your account
- Keep your account information and contact details up to date
- Pay all charges and fees in a timely manner
- Use the Services in compliance with all applicable laws, regulations, and our Acceptable Use Policy
- Safeguard your account credentials and not share them with unauthorized individuals
- Provide reasonable access to your premises for installation, maintenance, and equipment retrieval
- Not resell, redistribute, or share your Services with third parties without our written consent
- Promptly report any service issues, equipment malfunctions, or security concerns to SecureNet
6. Service Standards and Outages
SecureNet strives to provide reliable, high-quality fiber Internet service. However, we do not guarantee uninterrupted or error-free service. Our Services may be temporarily unavailable due to scheduled maintenance, equipment failure, network upgrades, force majeure events, or other causes beyond our reasonable control.
SecureNet will make commercially reasonable efforts to notify subscribers in advance of planned maintenance that may affect service availability. We will also make reasonable efforts to restore service as quickly as possible following any unplanned outage.
Service speeds are provided on a "up to" basis and may vary depending on network conditions, the number of connected devices, hardware limitations, and other factors. For information about typical speeds and network performance, please refer to our broadband nutrition labels and Open Internet Policy.
7. Acceptable Use
Your use of our Services is subject to our Acceptable Use Policy ("AUP"), which is incorporated into these Terms by reference. The AUP is available on our website at securenetfiber.com/legal/acceptable-use. Violation of the AUP may result in suspension or termination of your Services.
8. Termination and Suspension
Termination by Subscriber
You may cancel your Services at any time by contacting SecureNet by phone or email. Your service will remain active through the end of your current billing period. No prorated refunds will be issued for partial months of service.
Early Termination Fee
If you cancel your Services within the first 90 days of installation, a drop recovery fee of $200 will apply. This fee covers the cost of the fiber infrastructure installed at your premises. After the initial 90-day period, residential subscribers may cancel at any time without penalty.
Termination by SecureNet
SecureNet may suspend or terminate your Services at any time, with or without notice, for the following reasons:
- Non-payment or delinquent account balance
- Violation of these Terms or the Acceptable Use Policy
- Fraudulent, abusive, or illegal activity
- Conduct that threatens the integrity, security, or performance of our network
- Failure to return equipment following a previous service termination
- Any other reason permitted by law
Equipment Return
Upon termination of Services, all SecureNet-owned equipment must be returned within 15 days. Failure to return equipment may result in equipment replacement charges.
9. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. SECURENET MAKES NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
SECURENET DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. SECURENET DOES NOT WARRANT THAT ANY DATA OR INFORMATION TRANSMITTED OVER OUR NETWORK WILL BE SECURE OR THAT ANY STORED DATA WILL BE PRESERVED.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SECURENET AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, AND CONTRACTORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, DATA, BUSINESS, OR GOODWILL, REGARDLESS OF THE THEORY OF LIABILITY.
IN NO EVENT SHALL SECURENET'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES EXCEED THE TOTAL AMOUNT YOU PAID TO SECURENET FOR SERVICES DURING THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
11. Dispute Resolution and Arbitration
In the event of any dispute, claim, or controversy arising out of or relating to these Terms or the Services, you and SecureNet agree to first attempt to resolve the matter through informal negotiation by contacting SecureNet directly.
If informal resolution is unsuccessful, any dispute shall be resolved through binding arbitration conducted in Kanawha County, West Virginia, in accordance with the rules of the American Arbitration Association. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
You agree to pursue claims against SecureNet only in your individual capacity and not as a plaintiff or class member in any purported class action, collective action, or representative proceeding. The arbitrator may not consolidate more than one person's claims and may not preside over any form of class or representative proceeding.
12. Indemnification
You agree to indemnify, defend, and hold harmless SecureNet and its officers, directors, employees, agents, affiliates, and contractors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Services, your violation of these Terms, or your violation of any applicable law or the rights of any third party.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of West Virginia, without regard to its conflict of laws principles. Any legal action or proceeding not subject to arbitration shall be brought exclusively in the state or federal courts located in Kanawha County, West Virginia.
14. General Provisions
- Entire Agreement: These Terms, together with the Acceptable Use Policy, Privacy Policy, and any applicable service agreement, constitute the entire agreement between you and SecureNet with respect to the Services.
- Severability: If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
- Waiver: The failure of SecureNet to enforce any provision of these Terms shall not constitute a waiver of that provision or the right to enforce it in the future.
- Assignment: You may not assign or transfer your rights or obligations under these Terms without our prior written consent. SecureNet may assign its rights and obligations without restriction.
- Notices: SecureNet may provide notices to you by email, postal mail, or by posting on our website. Notices to SecureNet should be sent to the contact information provided below.
- Force Majeure: SecureNet shall not be liable for any failure or delay in performing its obligations due to circumstances beyond its reasonable control, including but not limited to natural disasters, acts of government, labor disputes, power failures, equipment failures, and third-party service disruptions.
15. Miscellaneous
Headings in these Terms are for convenience only and shall not affect the interpretation of any provision. The words "include", "includes", and "including" shall be deemed to be followed by the phrase "without limitation." These Terms do not create any third-party beneficiary rights.
