Acceptable Use Policy
Guidelines for responsible use of SecureNet Fiber services.
Effective Date: July 1, 2025
This Acceptable Use Policy ("AUP") governs the use of all Internet, voice, and related telecommunications services (collectively, the "Services") provided by WV AirNet, LLC d/b/a SecureNet ("SecureNet", "we", "us", or "our"). This AUP applies to all subscribers, users, and any person who accesses or uses the Services (collectively, "you" or "Subscriber").
By using our Services, you agree to comply with this AUP. This AUP is incorporated by reference into our Terms of Service. Violation of this AUP may result in suspension or termination of your Services and may expose you to civil or criminal liability.
1. Purpose
The purpose of this AUP is to protect the integrity, security, and reliability of SecureNet's network and Services, and to ensure that all subscribers can enjoy a safe and productive online experience. SecureNet is committed to providing high-quality fiber Internet service, and this AUP is designed to prevent abusive, harmful, or illegal activities that could degrade the experience for other users or expose SecureNet to liability.
2. Prohibited Activities
The following activities are strictly prohibited when using SecureNet's Services. This list is not exhaustive, and SecureNet reserves the right to determine, in its sole discretion, whether any conduct violates this AUP.
2.1 Illegal Use
You may not use the Services for any purpose that is unlawful or prohibited by applicable federal, state, or local law. Prohibited activities include, but are not limited to:
- Transmitting, distributing, or storing material that violates any applicable law or regulation
- Engaging in fraud, identity theft, phishing, or other deceptive practices
- Distributing or trafficking in child sexual abuse material (CSAM)
- Violating copyright, trademark, trade secret, or other intellectual property rights
- Unauthorized access to computer systems, networks, or data (commonly known as "hacking")
- Using the Services to facilitate or promote illegal gambling, drug trafficking, or other criminal activity
- Threatening, harassing, stalking, or intimidating any person
2.2 Network Abuse
You may not engage in any activity that disrupts, degrades, or interferes with the operation of SecureNet's network or the ability of other users to access and use the Services. Prohibited activities include:
- Launching or facilitating denial-of-service (DoS) or distributed denial-of-service (DDoS) attacks
- Sending or facilitating the sending of excessive or malicious network traffic designed to overwhelm systems or services
- Introducing viruses, worms, Trojan horses, ransomware, or other malicious code into the network
- Engaging in IP address spoofing, packet manipulation, or forging of headers or identifiers
- Operating open proxies, open relays, or other services that may be exploited by third parties to abuse the network
- Consuming excessive bandwidth or resources in a manner that negatively impacts other subscribers
2.3 Unsolicited Communications
You may not use the Services to send unsolicited bulk or commercial messages, commonly known as "spam." This includes:
- Sending unsolicited bulk email, whether commercial or otherwise
- Sending messages to recipients who have not consented to receive them
- Using the Services to collect email addresses or other contact information without consent ("harvesting")
- Sending messages with deceptive, misleading, or forged headers or subject lines
- Operating mailing lists without proper opt-in and opt-out mechanisms
2.4 Security Threats
You may not use the Services to compromise or attempt to compromise the security of any system, network, or data. Prohibited activities include:
- Attempting to probe, scan, or test the vulnerability of any system or network without authorization
- Attempting to intercept, monitor, or capture data or communications not intended for you
- Attempting to gain unauthorized access to any account, system, or network
- Distributing tools, software, or instructions designed to facilitate unauthorized access to systems or data
- Failing to secure your own network and devices, thereby allowing them to be used for malicious purposes by third parties
2.5 Misuse of Service
You may not use the Services in any manner that is inconsistent with their intended residential or commercial purpose. Prohibited activities include:
- Reselling, redistributing, or sharing the Services with third parties without SecureNet's written consent
- Using residential Services for commercial hosting, data center operations, or other enterprise-scale activities without a business service plan
- Operating servers or services that generate excessive traffic or consume disproportionate network resources without prior authorization
- Tampering with, modifying, or reverse-engineering any SecureNet-owned equipment
- Circumventing or attempting to circumvent any network management, security, or authentication measures
3. Subscriber Responsibility
You are responsible for all activity conducted through your account and your connection to the Services, whether or not you authorized or participated in that activity. This includes activity by family members, guests, employees, contractors, or any other person who accesses the Services through your connection.
You are responsible for securing your network, devices, and account credentials. SecureNet recommends that all subscribers use strong passwords, keep software and firmware up to date, and employ appropriate security measures such as firewalls and antivirus software.
If you become aware of any unauthorized use of your account or any security breach, you must notify SecureNet immediately.
4. Enforcement and Violations
SecureNet reserves the right to investigate any suspected violation of this AUP and to take appropriate action, including but not limited to:
- Issuing a warning
- Temporarily suspending your Services
- Permanently terminating your Services
- Removing or blocking access to content that violates this AUP
- Reporting the activity to law enforcement or regulatory authorities
- Cooperating with law enforcement investigations and legal proceedings
- Pursuing civil or legal remedies
SecureNet may take enforcement action at any time, with or without notice, depending on the severity of the violation. Repeated or serious violations may result in immediate termination without prior warning.
SecureNet is not required to monitor the content or activity of its subscribers but reserves the right to do so in order to enforce this AUP and protect the network.
5. No Liability
SecureNet shall not be liable for any damages, losses, or expenses arising from enforcement of this AUP, including but not limited to the suspension or termination of your Services. SecureNet shall not be liable for any failure to enforce this AUP in any particular instance or for any delay in taking action.
SecureNet does not assume responsibility for the content transmitted, stored, or accessed by subscribers through the Services. You acknowledge that SecureNet is not obligated to monitor or filter content and that you use the Services at your own risk.
6. Updates to This Policy
SecureNet reserves the right to modify this AUP at any time. Changes will be posted on our website and will be effective immediately upon posting. Your continued use of the Services after any modification constitutes your acceptance of the updated AUP.
